Definition of opposition to trademark registration

As to trademarks that pass the preliminary approval, prior rights holders and interested parties can oppose to Trademark Office within 3 months from the publication of the trademark when they find it is similar to the trademark they have registered.

As to counterfeit registered trademarks, if no opposition has been filed at the specified period, the registration shall be approved, a certificate of trademark registration shall be issued. Once the trademark is registered, it will be difficult to exercise rights again when invalidity is untenable though application for invalidity can be filed.
